This Refund Policy governs all payments made to Elite Consulting Club, the trading name of Elite Consulting FZC-LLC (TRN 104062296900003), registered at Sharjah Publishing City (SPC) Free Zone, Sheikh Mohammed Bin Zayed Rd, Sharjah, United Arab Emirates ("Elite Consulting", "we", "us"). It forms part of, and must be read together with, our Terms & Conditions. By proceeding with any payment, you acknowledge that you have read, understood, and agree to be bound by this Policy.
1. All Payments Final and Non-Refundable
All prices are final, and payments made to Elite Consulting are strictly non-refundable under any circumstances. By proceeding with payment, you agree to these terms, acknowledging that refunds are not guaranteed and that the default position is that all payments are final and non-refundable.
This Policy applies to all fees paid to Elite Consulting, including but not limited to service fees, subscription fees, membership fees, deposits, retainers, and any advance payments, regardless of the payment method used or the currency in which payment was made.
2. Exceptional Partial Refunds (Discretionary)
In exceptional cases, and solely at the discretion of Elite Consulting, a partial refund of up to a maximum of 50% of the total payment may be considered. Such refunds, if granted, will be processed via bank transfer and may take up to 45 working days to complete.
Elite Consulting shall not be held liable for any delays associated with the refund process. The decision to issue a refund, including the amount and eligibility, rests entirely with Elite Consulting and is not subject to negotiation or appeal. For the avoidance of doubt, no refund exceeding 50% of the total payment will be granted under any circumstances.
The consideration of any discretionary refund does not constitute an admission of liability, fault, or wrongdoing by Elite Consulting, and shall not create any precedent or entitlement in respect of any other payment or client.
3. No Refund Where Services Have Commenced
No refund of any kind will be granted where, prior to the refund request:
- the services, or any part of them, have commenced;
- any document, application, or filing has been prepared, lodged, or submitted to a government authority, free zone, bank, registrar, or other third party on your behalf; or
- any work product, advice, deliverable, or introduction has been provided to you.
In each such case the fees are deemed fully earned and are non-refundable, irrespective of the outcome of any application, filing, or engagement.
4. No Refund on Termination for Cause
No refund will be issued where the engagement is suspended or terminated as a result of:
- AML/KYC failure — your failure to satisfy anti-money-laundering, know-your-customer, or sanctions screening requirements, or your failure to provide required verification documents;
- Client breach — your breach of the Terms & Conditions or of this Policy, or your failure to cooperate, respond, or provide instructions or materials within a reasonable time;
- False information — your provision of false, misleading, incomplete, or fraudulent information or documents.
In any such case, all fees paid are forfeited and non-refundable, and Elite Consulting reserves all further rights and remedies available to it at law.
5. Deposits, Government and Third-Party Fees
Deposits are strictly non-refundable and are applied towards the cost of the engagement.
Government fees, free zone fees, registrar fees, banking fees, notarisation, translation, courier, and any other third-party charges are strictly non-refundable, whether paid by you directly or advanced by Elite Consulting on your behalf, once they have been incurred, paid, or committed. These charges are levied by third parties and fall outside the control of Elite Consulting.
6. Promotional and Discounted Pricing
Any payment made under promotional, discounted, bundled, or special-offer pricing is final and strictly non-refundable and is not eligible for the discretionary partial refund described in Section 2. Promotional pricing is offered on the express condition that the payment is non-refundable.
7. Chargebacks and Payment Disputes Prohibited
You agree not to initiate any chargeback, payment reversal, or dispute with your bank, card issuer, or payment provider in respect of any payment made to Elite Consulting. Initiating a chargeback or payment dispute is strictly prohibited and constitutes a material breach of this Policy and of the Terms & Conditions.
In the event of any wrongful or unauthorised chargeback or payment dispute, Elite Consulting shall be entitled to recover the disputed amount in full, together with all resulting costs, fees, and expenses (including administrative charges, bank and payment-provider fees, and legal costs), and to suspend or terminate all services immediately and without refund.
8. No Refund for Third-Party Decisions or Outcomes
Elite Consulting's fees remunerate the professional work, time, expertise, and introductions provided — not any particular outcome. Elite Consulting does not control, and does not warrant or guarantee, the decisions of any third party.
Accordingly, the rejection, refusal, delay, suspension, or closure of any application, account, license, registration, or status by any bank, government authority, registrar, free zone, immigration authority, or other third party does not entitle you to any refund, in whole or in part. This includes, without limitation:
- bank-account applications declined after an introduction has been made, or accounts subsequently suspended or closed by the bank;
- visa or residency applications refused, delayed, or revoked by any immigration authority;
- company licenses or registrations rejected, delayed, or withdrawn by any free zone, registrar, or government authority.
In each such case the fees are deemed fully earned upon performance of the relevant work, and no refund, credit, or reduction will be granted on account of the third party's decision or the outcome achieved.
9. Consultations and Scheduled Sessions
A consultation is deemed fully rendered once it has been delivered, regardless of its duration, content, or your assessment of its value, and the fee for it is fully earned and non-refundable.
- No-shows — if you fail to attend a scheduled session, the session is forfeited together with any fee paid for it;
- Late cancellations — cancellations made less than 48 hours before the scheduled start time forfeit the session and any fee paid for it;
- Client-caused rescheduling — repeated or late rescheduling attributable to you is treated as a cancellation and forfeits the session and any fee paid for it.
Free or complimentary calls carry no monetary value and create no entitlement of any kind, including no entitlement to a refund, credit, substitute session, or any paid service.
10. Force Majeure and Events Beyond Our Control
No refund shall arise where the performance of any service is delayed, interrupted, or prevented by an event beyond the reasonable control of Elite Consulting, including but not limited to:
- acts of God, natural disasters, war, hostilities, civil unrest, or acts of terrorism;
- epidemics, pandemics, and related public-health measures;
- acts, orders, or omissions of any government or regulatory authority, or changes in law, regulation, or policy;
- banking-system failures, restrictions, or suspensions, payment-network outages, and the imposition of sanctions or embargoes;
- strikes, labour disputes, cyber incidents, and failures of telecommunications, internet, or utility services.
During any such event, Elite Consulting's obligations are suspended without liability, and all fees paid remain non-refundable. Performance of the affected obligations will resume, so far as reasonably practicable, once the event has ended.
11. Refund Procedure and Conditions
This Section governs the discretionary partial refunds described in Section 2. Compliance with each condition below is a strict precondition to any refund being considered; failure to comply extinguishes any request.
- Written request within 14 days — any refund request must be submitted in writing to the contact email set out in this Policy within 14 days of the event giving rise to it, stating full reasons and enclosing all supporting documents. Requests submitted after this period are irrevocably waived and will not be considered under any circumstances;
- AML/verification checks — any approved refund will be paid only after satisfactory completion of any anti-money-laundering, know-your-customer, or other verification checks that Elite Consulting may require;
- Original payer and payment source only — approved refunds are paid exclusively to the original payer and to the original payment source used for the payment. No refund will be made to any third party or to any alternative account, card, or method;
- Charges borne by the client — all bank charges, transfer fees, intermediary fees, currency-conversion costs, and exchange-rate differences arising from the refund are borne by you and will be deducted from the refund amount;
- Original currency — refunds are processed in the currency in which the original payment was made; Elite Consulting bears no responsibility for exchange-rate fluctuations between payment and refund.
12. Set-Off and Outstanding Amounts
Any refund that Elite Consulting may, in its discretion, approve may be reduced by any amounts you owe to Elite Consulting, including without limitation unpaid invoices, chargeback-related costs and fees, and government or third-party fees advanced by Elite Consulting on your behalf. Elite Consulting may set off any such amounts against the refund before payment.
You must pay all invoices issued by Elite Consulting in full and without any set-off, deduction, counterclaim, or withholding of any kind. A pending or contemplated refund request does not entitle you to withhold, delay, or reduce any payment otherwise due.
13. Acceptance
By making any payment to Elite Consulting, you confirm that you have read, understood, and agree to be bound by this Refund Policy, and you accept that all payments are final and non-refundable except as expressly and discretionarily provided in Section 2 and subject to the conditions in Section 11.
14. Governing Law and Jurisdiction
This Refund Policy is governed by and construed in accordance with the laws of the United Arab Emirates, and the parties submit to the exclusive jurisdiction of the courts of Dubai. English is the governing language of this Policy; any translation is provided for convenience only, and in the event of any conflict the English version prevails.
